Le gouvernement britannique a, semble-t-il, manifesté son intention de considérer O'Meara comme un membre de la famille Bonaparte. Il serait ainsi soumis aux mêmes restrictions que les résidents français de Sainte-Hélène. O'Meara proteste qu'il appartient au corps de la marine britannique, qu'il est rétribué par la Couronne et donc soumis à la loi britannique. Il se trouve désormais dans une situation équivoque.
